Two Muslim women in Belgium and France were fired from there work place for refusing to remove their headscarves. The court is in support of this, insinuating that companies should be able to ban the wearing of any visible political, philosophical or religious signs. They said a ban on headscarves did not constitute direct discrimination, as long as a general ban on other symbols was in place.
Statement released by court reads, “An internal rule of an undertaking which prohibits the visible wearing of any political, philosophical or religious sign does not constitute direct discrimination. However, in the absence of such a rule, the willingness of an employer to take account of the wishes of a customer no longer to have the employer’s services provided by a worker wearing an Islamic headscarf cannot be considered an occupational requirement that could rule out discrimination.”
This motion is causing a lot of up roars and people that are involved feels like they are been discriminated because of their religious belief.
The Muslim women took their cases to national courts, who referred the matter to the European Court of Justice ECJ.
